1. Purpose and role of Marviews
These terms and conditions apply to the real estate services offered under the Marviews brand: property presentations, introductions, support or coordination, according to the offer accepted.
The quotation or contract identifies the contracting service provider, their contact details, the assignment entrusted to them and the role of Marviews. Information about the website publisher is provided in the legal notice.
2. Definition of the assignment
Each service is subject to a quotation, a contract or, where necessary, a mandate accepted before it begins.
This document specifies the planned actions, excluded services, timeframes, the client's obligations and any involvement of partners.
Marviews may not bind the client, sign on their behalf or receive funds for their account without appropriate authorisation. Any exclusivity must be expressly agreed.
3. Fees and expenses
The amount of the fees or their calculation method, applicable taxes, the person responsible for paying them and payment deadlines are specified before the client commits.
Where remuneration depends on the completion of a transaction, the event triggering entitlement to it is clearly defined. Additional expenses require prior agreement.
Mandatory rules on the allocation of expenses remain applicable. In particular, for residential lettings falling under the residential regime of the Spanish Urban Leases Act, property management and contract formalisation expenses are borne by the landlord.
4. Duration, amendment and end of the assignment
The contract specifies the duration of the assignment, the renewal conditions and the termination procedures.
Any change to the scope or price is subject to prior agreement. At the end of the assignment, any amounts due are determined according to the services performed, the conditions accepted and the client's statutory rights.
5. Partners and responsibilities
Partners working directly with the client are identified, along with their services, fees and responsibilities. Any referral remuneration is disclosed.
The client provides accurate information and the supporting documents necessary for the assignment. Marviews remains responsible for its own services and obligations; the use of a partner does not remove them.
An estimate of price or timeframe does not constitute a guarantee of sale, letting or return. Express commitments and statutory guarantees remain applicable.
6. Distance contracts and withdrawal
For service contracts concluded at a distance with a consumer and subject to the Spanish withdrawal regime, the consumer has, in principle, fourteen days from the conclusion of the contract to withdraw.
The procedures for exercising this right and the statutory form are provided before any commitment is made.
An early start requires an express request from the client. Loss of the right of withdrawal after full performance is subject to compliance with the statutory conditions, including the client's prior consent and acknowledgement of this consequence.
7. Data and complaints
Personal data is processed in accordance with the privacy policy.
Any question or complaint may be submitted via our contact form, specifying the service concerned. This process does not limit the client's legal remedies.
These terms and conditions do not replace the documents specific to a sale or rental and do not limit any applicable mandatory rights.
