Tourist rental terms

1. Purpose and parties involved

These terms and conditions govern the tourist stays offered on marviews.com in Andalousie.

The booking offer identifies the accommodation, its regulatory references, the contracting service provider and the role of Marviews. Each party remains responsible for the obligations incumbent upon it.

The specific terms and conditions communicated and accepted before booking supplement this document, without reducing the client's mandatory statutory rights.

2. Enquiry and booking

A request for availability or a quotation does not constitute a confirmed booking.

Before making any commitment, the client receives the accommodation's characteristics, the dates, the permitted capacity, the total price and the payment and cancellation terms.

The booking becomes binding in accordance with the acceptance and payment procedures specified in the offer. Proof of booking is sent on a medium that can be retained, including by email.

3. Price and payment

The total price includes the mandatory charges and applicable taxes disclosed before booking. Optional services are charged only after acceptance by the client.

Supplies and services that regulations require to be included in the price, notably water, electricity, linen and pre-arrival cleaning, do not give rise to unforeseen surcharges.

Any advance payment, the balance, their due dates and the payment methods are specified in the offer. A receipt is provided for payments received.

4. Cancellation and changes

The specific terms and conditions specify the cancellation deadlines, any amounts retained and the refund procedures. In the absence of an express agreement, the default provisions of Andalusian regulations apply.

Any change to dates or occupancy requires written agreement.

In the event of cancellation by the service provider, the amounts due are refunded and any applicable compensation remains payable. Cancellation on grounds of duly substantiated force majeure does not incur a penalty.

For tourist accommodation booked for specific dates, the statutory fourteen-day right of withdrawal applicable to certain distance contracts does not apply. The cancellation rights provided for in the offer and by law remain applicable.

5. Security deposit

Where a security deposit is requested, its amount, the method of collection and the time limit for its return are specified before booking.

Any deduction must correspond to a justified amount, notably for damage attributable to the client, and must be explained with the available supporting evidence. Normal wear and tear cannot be charged as damage.

6. Arrival and departure

The times, exact address and key handover arrangements are communicated to the client. Any delay must be reported to the designated contact.

Travellers provide the information legally required for their registration. The processing arrangements are set out in the privacy policy.

An assistance number accessible twenty-four hours a day during the stay is provided by the operator.

7. Use of the accommodation

The client must comply with the permitted occupancy limit, respect the neighbours, and follow the safety instructions and the rules of the accommodation and the residence.

The rules concerning pets, smoking, visitors and events are specified before booking. The accommodation must be used with care and returned in the agreed condition.

Any damage or malfunction must be reported as soon as it is discovered.

8. Facilities and communal areas

Access to swimming pools, sports facilities, wellness areas and other communal facilities depends on the conditions announced for the stay.

Known restrictions are communicated before booking. Any unavailability affecting a promised service is assessed in accordance with the contract and the client's rights.

9. Incidents and complaints

For an incident during your stay, contact the person indicated in the booking directly to enable prompt intervention.

Seeking an amicable solution does not limit the client's legal remedies.

10. Applicable law and client protection

The mandatory rules applicable to the accommodation and the tourist service in Andalusia remain fully applicable.

No provision of these terms excludes any legal liability or deprives the client of the protections and competent courts to which they may legally have recourse.
