Digital services terms
1. Purpose and service provider
These terms and conditions apply to the digital services offered under the Marviews brand: creation or adaptation of websites, content and digital tools, automation, training and support in artificial intelligence (AI), according to the accepted offer.
The quotation identifies the contracting service provider and their contact details. Information about the website publisher is provided in the legal notice.
2. Quotation and scope
Each assignment is subject to a quotation or contract accepted before it begins.
It specifies the deliverables, features, formats, languages, deadlines, prices, payment due dates and number of revisions included. Exclusions, technical dependencies and items expected from the client are also indicated.
Any additional request is subject to agreement on its cost and its impact on the schedule before implementation.
3. Collaboration, delivery and approval
The client provides the content, information, access and approvals necessary for the assignment. The client ensures that they hold the required rights to the materials provided.
Delays or difficulties likely to affect delivery are reported. Any adjustment to the schedule is explained and agreed between the parties.
Deliverables are presented according to the approval criteria defined in the quotation. Corrections necessary to comply with the agreed scope are distinguished from new requests. Approval does not remove applicable statutory warranties.
4. Prices and third-party services
The quotation distinguishes between Marviews' fees, applicable taxes and the costs of third-party services: hosting, domain, software, licences, usage and subscriptions.
Recurring costs, their renewal conditions and the person responsible for paying them are specified before any commitment is made. No additional paid service is subscribed to on behalf of the client without their agreement.
5. Accounts, content and usage rights
The client retains their rights to the content they provide.
Accounts and domains created specifically for the client are set up in their name where the service permits, unless expressly agreed otherwise. Access and transfer arrangements are specified in the quotation.
For the creations delivered, the contract defines the rights granted, their scope, duration, territory and the conditions under which they take effect. It specifies the source files and editable elements provided.
Pre-existing tools and third-party components remain subject to their own rights and licences. Their relevant restrictions are disclosed before any commitment is made.
6. Maintenance and subscriptions
The quotation indicates whether hosting, backups, updates, maintenance or support are included or are subject to a separate agreement.
This agreement specifies the duration, work covered, response times, rates and termination arrangements.
The absence of a maintenance contract does not reduce statutory obligations relating to conformity, correction or updates where they apply.
7. Automation and artificial intelligence
Where a service uses AI or automation, the intended uses, relevant limitations and necessary human checks are specified.
Results may require verification before use. No commercial performance, search engine ranking or profitability is guaranteed without an express commitment.
These clarifications do not relieve Marviews of its obligation to provide a service that complies with the contract.
8. Confidentiality and personal data
The parties protect confidential information received in the course of the assignment and restrict access to persons who need it.
The privacy policy describes the processing carried out by Marviews on its own behalf. If Marviews processes personal data on behalf of the client, an appropriate agreement governs that processing where required.
9. Withdrawal and end of assignment
The withdrawal rights applicable to the consumer client are specified before the contract is concluded.
For distance contracts subject to the Spanish legal framework, the period is, in principle, fourteen days. Starting a service early requires an express request. The loss of the right of withdrawal depends on the nature of the service and compliance with the legal conditions; it does not result solely from acceptance of the quotation.
The contract specifies the termination conditions, the accounting for services performed and the arrangements for handing over deliverables, access and data. The client's mandatory rights remain applicable.
